Statement of Rights and Responsibilities
This Statement of Rights and Responsibilities ("Statement," "Terms," or "SRR") derives from the Jobface Principles and are the terms of service that governs our relationship with users and others who interact with Jobface, as well as our products and services. By using or accessing the Jobface Services, you agree to this Statement, as updated from time to time in accordance with Section 3. below.
Because Jobface provides a wide range of Services we may ask you to review and accept supplemental terms that apply to your interaction with a specific app, product, or service. To the extent those supplemental terms conflict with this SRR, the supplemental terms associated with the app, product, or service govern with respect to your use of such app, product or service to the extent of the conflict.
Terms & Conditions of Use
1. Your Relationship with Jobface
1.1 Your use of the Jobface website (the “Website”) and any Jobface products, software, data feeds and services, provided to you on or from or through the Website by Jobface (collectively the “Service”) is subject to the terms of a legal agreement between you and Jobface. “Jobface” means Jobface Limited (a company incorporated in Ireland with company registration number 575217 and a registered office at 6 Manor Hall, Mount Brown, Kilmainham, Dublin 8) “Jobface.ie”, “we”, “us” or “our”.
1.3 The Terms form a legally binding agreement between you and Jobface in relation to your use of the Service. It is important that you take the time to read them carefully.
2. Accepting the Terms
2.1 In order to use the Services, you must firstly agree to the Terms. You may not use the Service if you do not accept the Terms. In lieu of formal acceptance, any use of the Service as a registered will assume that you are in agreement with the Terms.
2.3 You may not use the Service and may not accept the Terms if (a) you are not of legal age to form a binding contract (b) you are a person who is either barred or otherwise legally prohibited from receiving or using the Service.
2.4 You should print off and save a local copy of the Terms for your records.
3. Change to the Terms
3.1 We reserve the right to update the Term of Use at any time without notice to you. Users are responsible for reviewing regularly information posted online to obtain timely notice of such changes. If you do not agree to the modified Terms you must stop using the Service. Your continued use of the Service after the date of the modified Terms are posted will constitute your acceptance of the modified Terms.
4. Jobface Profile Accounts
4.1 In order to access some features of the Website and App or other elements of the Service, you will have to create a Jobseeker/Employer Profile Account. When creating your account, you must provide accurate and complete information.
4.2 If you register to use the Jobface Website or App you will be asked to create a password. In order to prevent fraud, you must keep this password confidential and must not disclose it or share it with anyone. It is highly recommend that you follow choose a strong password (mix of random letters, numbers and characters) that is hard for unrelated parties to obtain.
4.3 You must notify Jobface immediately of any breach of security or unauthorised use of your Jobface Account that you become aware of by contacting firstname.lastname@example.org immediately.
4.4 If Jobface has reason to believe that there is likely to be a breach of security or misuse of the Jobface Website or App or a breach of these Terms, we may require you to change your password or we may suspend your account.
4.5 You agree that you will be solely responsible (to Jobface, and to others) for all activity that occurs under your Jobface account.
4.6 If you register, you should ensure that the details provided by you on registration or at any time are correct and complete. You are solely responsible for keeping your own data accurate, complete and up to date. Please update any changes to the information that you provided when registering by updating your personal details. As you are completely in control of your Profile, Jobface accepts no responsibility for verifying that your details are up to date.
4.7 We may suspend or cancel your registration immediately at our discretion or if you breach any of your obligations under these Terms and Conditions.
4.8 We will not be liable if for any reason our site is unavailable at any time or for any period. From time to time, we may restrict access to some parts of our site, or our entire site, at our discretion.
5. Cancelation of Registration
5.1 You can cancel your registration at any time by emailing us at email@example.com requesting same.
7.1 We make services available to registered users on Jobface.ie which may include, but not limited to, the ability to create, publish and manage written advertisements for job vacancies, creation of employers profile page, creation of jobseekers profile page, uploading of jobseekers and employers promotional videos, contact other users of the website in response to advertisements published on the Website and search the Website for advertisements (the “Services”).
8. Unlawful & Prohibited Use
8.1 You are prohibited from using the Website and/or Services in any manner that could damage, disable, overburden, or impair the Jobface.ie server or be deemed to be in competition with our business activities (as determined by us at our sole discretion)
8.2 You may not attempt to gain unauthorised access to any Services, other accounts, computer systems or networks connected to any Jobface.ie server or to any of the Services, through hacking, password mining or any other means. You may not obtain or attempt to obtain any materials or information through any means not intentionally made available through the Services.
8.3 You are prohibited from using or removing any information or material (including designs, text, graphics, videos, logos, images and related content) written, published shared or otherwise appearing on the Website in respect of any of the Services, and for the avoidance of doubt this shall include any and all information or material contained in any advertisements or profiles appearing on the Website, (the “Content”) from the Website by any means. You acknowledge that we are the owner of the intellectual property rights in the Content (whether jointly or solely) and that our prior written permission is required for any such use or removal of the Content. For avoidance of doubt, use of the Content does not give you any proprietary rights in the Content.
9. Exclusion of Liability
9.1 Jobface is a conduit to facilitate the introduction of Jobseekers with Employers. Jobface does not verify or guarantee the Jobseekers details irrespective as to whether they are provided or supplied to the Employer. Jobface accepts no responsibility as to the suitability of jobseekers who respond to listings or advertisements.
9.2 It is the responsibility of the Employer to take up references of the Jobseeker and to check them prior to engaging the Jobseeker, thereby satisfying themselves to the suitability of the Jobseeker.
9.3 In no event will Jobface be liable for any damages including, without limitation indirect or consequential damages, or any damages whatsoever arising from use or loss of use, data, or profits, whether in action of contract or negotiation, arising out of or in connection with the use of the Website.
9.4 No warranty is given that the Website shall be available on an uninterrupted basis, and no liability can be accepted in respect of losses or damage arising out of such unavailability.
9.5 We accept no liability in respect of losses or damages arising out of changes made to the content of the Website by any third parties. Access to and use of the Website is at the users’ own risk.
9.8 Jobface does not accept liability of any description, including liability for negligence, or any damages or losses (including, but without limitation to indirect or consequential loss, or loss of business, revenue, profits, contracts, anticipated loss of savings, loss of goodwill, use of opportunity, wasted management or office time) howsoever resulting from the Employers use of (or inability to use) this Site, or results of the use of this Site, any websites linked to it and any materials posted on it. This does not affect Jobface’s liability for any matter which cannot be excluded or limited under applicable law.
10. Names, Images & Logos
10.1 The names, images and logos identifying Jobface.ie or third parties and their products and services are proprietary marks of Jobface.ie and/or third parties.
11. Links to Other Websites
11.1 While using the Website you may access third party websites though links. Such third party websites are not under our control and we are not responsible for the availability of such websites or their contents.
11.2 Any links provided on the Website are provided for your interest or convenience only and do not represent or imply any endorsement by us of such linked websites and we cannot be held liable for any loss or damage which may arise from use of such third party websites or contracts entered into resulting from the use of such third party websites.
11.3 You acknowledge that the use of such third party websites is governed by the terms and conditions of use applicable to such websites.
12. Vacancy Advertising & Database Access Clients
12.1 Vacancy Advertising and Database Access Clients must abide by the Jobface.ie Terms and Conditions of Sale which outlines the Agreement of Services entered into between themselves and Jobface.ie.
13. Jobseeker User Accounts
13.1 Jobseekers may decide to register their Profile in our database through sign up and 'my profile' sections on Jobface.ie. Users can choose to make their Profile searchable (a feature which may not be available on the site at the time of reading) for inclusion in our Profile database product. This Service allows your Profile to be viewed by recruiters/employers who have subscribed to this service. It also means that you can attach your Profile to your online job application(s).
13.2 We endeavour to grant access to the Profile database only to recruiters who agree to abide by our Terms and Conditions. However, should a third party gain access to your Profile by evading our security measures, we cannot be held responsible.
13.3 You may remove your Profile from our database at any time. However, recruiters who have already accessed your Profile may have kept a copy of it in their own files. Please note that we cannot be held responsible for the retention, use, or privacy of your Profile in these instances.
13.4 In the interest of your privacy and the maintenance of an up-to-date Profile database, Profiles are removed from recruiters access if they have not been updated for a period of 12 months. If you wish for your Profile to remain in the searchable database, you must update your details at least once every 12 months.
14. Ensuring Quality of Content
- 14.1.1 Only real jobs (i.e. positions that are currently available or reasonably expected to be so in the near future) can be posted to the Website.
- 14.1.2 To ensure equal exposure for all positions advertised on the Website, job adverts may only be updated/amended once per day.
- 14.1.3 Once a new job has been added, this job may only be reposted and treated as a new position once 30 days have elapsed, other than in special circumstances. Cloning and reposting jobs more frequently than this is misleading for jobseekers.
- 14.1.4 It should be made clear in the job description if a jobseeker is not applying for a specific position, but rather their Profile is being added to a bank of Profiles for future positions that may arise.
15. Payment & Security Statement
15.1 In relation to listings, subscriptions and all other ancillary services a payment is required in full before any such service can commence.
15.2 Security statement
- 15.2.1 Jobface.ie uses Stripe Payments to provide a secure, robust and reliable payment processing service. Information security is their top business priority. To this end they have invested in extensive security controls and infrastructure.
- 15.2.2 Stripe Payments are certified and approved by several leading financial institutions. Their systems and security controls are based on current industry standards. There are several layers of technology in place to ensure the confidentiality, authentication and integrity of information.
- 15.2.3 Stripe Payments have been accredited with the AIS (Account Information Security) certification by VISA and is one of the few companies in Europe to achieve this.
